Please read these BCC T&C carefully. BCC T&C set out your rights and obligations in relation to the BCC. By ordering, purchasing, collecting, holding and/or using the Tickets, you certify that (i) you have read, understood and accept BCC T&C and you agree to comply with them; and (ii) any Entrant you may have purchased a Ticket for is aware of, accepts and complies with these BCC T&C.

The Promoter of the Event is the Ministry of Youth and Sport of the Government of Azerbaijan who has appointed BCC to be its event delivery company for the Event.

1. Introduction

Unless otherwise specifically defined herein, defined terms shall have the meanings ascribed to them in Clause 3 of BCC T&C. Any person with authorisation or permission (individually an “Entrant” and collectively the “Entrants”) to attend any Event, enter into and/or remain at the Circuit, including, without limitation, pursuant to any ticket, pass, wristband, lanyard, card, permission, credential and/or other document or thing, is strictly subject to, and conditional upon, the Entrant’s acceptance of BCC T&C. Entrants are strongly encouraged to read and inform themselves with BCC T&C. By purchasing, using a ticket and/or attending any Event, entering into and/or remaining at the Circuit, each Entrant is deemed to have accepted and understood as binding on them, BCC T&C and any accompanying risks, obligations and responsibilities. Any Entrant who breaches BCC T&C may be liable to penalty and expulsion from an Event and/or the Circuit

2. Sale and Attendance Summary

  1. Attending the Circuit, including any Event held at the Circuit, may involve danger and risk to an Entrant’s personal safety. Entrants are hereby warned that there is a possibility of an accident causing injury, death or property damage or loss. Attendance is at the Entrant’s own risk. Each Entrant is responsible at all times for all children under their care. By purchasing, using a ticket and/or attending any Event, entering into and/or remaining at the Circuit, each Entrant is deemed to have accepted BCC T&C and any accompanying risks, obligations and responsibilities (Clause ‎5.3).
    If an Entrant is attending an Event and is required to hold a Ticket, the Entrant is reminded that the purchase of a Ticket is final. Except as provided in Clause ‎9.2, Tickets are non-refundable.
    BCC reserves the right to inspect and refuse bags or other items to be brought into the Circuit (Clause ‎10.2).
    In relation to certain Events and for safety and operational reasons, BCC may advise that children do not attend particular Events (Clause ‎10.3).
    In the event of adverse weather conditions, access to the Circuit may be denied and some Events delayed or cancelled at BCC’s sole discretion and at short notice (Clause ‎12.2).
    In relation to each Event, BCC reserves the right to, without notice and in any circumstances, add, withdraw, reschedule or substitute any particular person, group, car, race, team or personality from the Event and to amend Ticket prices, seating arrangements and audience capacity (Clause ‎12.1).
    BCC reserves the right, with reasonable cause, to refuse entry to any Entrant or remove any Entrant from the Circuit (Clause ‎5.6).
    Restrictions apply to items which Entrants bring into the Circuit which include professional video cameras and photography cameras and food and beverages (Clause ‎10.4 and Clause ‎13.2).
    Each Entrant agrees to assign to FOWC in writing the copyright and all other intellectual property in any Image or Recording that the Entrant creates, makes, stores or records of, at or in relation to the Event. (Clause 13.5).

3. Definitions

Associated Entities

means the sanctioning bodies, the FIA, the Title Sponsor (if any), FOWC and its affiliates, including FOM, Formula One Licensing B.V., Formula One Asset Management Limited, Formula One Hospitality and Event Services Limited, Formula Motorsport Limited and Formula One Marketing Limited, persons involved in the organisation, conduct and promotion of the Event and activities at the Circuit (including project engineers appointed by BCC or any suppliers, organisers, promoters, officials, marshals, rescue and medical staff) and the competitors and drivers (such parties to include where relevant all directors, officers, employees, agents, contractors, and affiliated companies)

Authorised Agents

means persons to whom BCC has granted the right to sell Tickets.

Authorised Retail Agents

refers to temporary or permanent retail outlets that BCC has granted the right to sell Tickets

Authorised Ticket Kiosks

refers to stand alone, self-service kiosks that BCC have developed to sell Tickets

Authorised Web Agents

refers to online agents whom BCC has granted the right to sell Tickets

means Baku City Circuit Operations Company

BCC T&C

means Baku City Circuit Operation Company Terms & Conditions of Ticket Purchase and Use as set out in this document as may be amended, modified or supplemented from time to time, including, but not limited to publication on the website www.bakucitycircuit.com

Booking Hotline

refers to the following number: +99412 404 13 90

Circuit or Venue

refers to the Baku City Circuit, the track and all areas in, around and within the Baku City Circuit which are used in any manner connected with an Event and/or set aside for other activities

Entrant(s)

has the meaning given in the introduction to these BCC T&C

Event

means the Grand Prix

FIA

means Federation Internationale de l’Automobile

FOM

means Formula One Management Limited

FOWC

means Formula One World Championship Limited and/or where the context requires shall include FOM or any employee, representative, agent or contractor acting on its or their behalf

Grand Prix

means the FORMULA 1 AZERBAİJAN GRAND PRIX 2022 and refers to any and all of the trial day, qualifying day and race day in relation thereto.

ID

means an identity card for citizens of the Republic of Azerbaijan, certificate of birth for underage persons, passport for foreigners, a document indicating identity for stateless persons which proves that its holder is a particular person. IDs must be valid and a valid photo on the ID is essential (except in relation to certificates of birth);

Order

means the legally binding statement of intention of the Purchaser to buy Tickets. In case of purchase through the BCC web page, information about your Tickets is placed in the Purchaser’s personal online account;

Police

means the Main Police Department of Baku City, or any other body tasked with providing security arrangements for the Circuit and/or an Event

Ticket

refers to any ticket issued by BCC which permits entry to an Event.

Ticket Purchase Confirmation

means a document provided by BCC to the Purchaser through their personal online account and/or by e-mail confirming the details of all purchased Tickets (including the price paid) and the unique transaction reference number;

Title Sponsor

means the title sponsor for a particular Event (from time to time).

Website

means the official website, www.bakucitycircuit.com

4. Interpretation

For the purposes of BCC T&C, except to the extent that the context otherwise requires:

  1. words utilising the singular shall include the plural and vice versa;
  2. words importing a specific gender shall include the other genders (male, female or non-binary);
  3. the headings are for convenience only and do not affect interpretation;
  4. any reference to conduct includes an omission, statement or undertaking, whether or not in writing;
  5. a reference to a “Clause” is a reference to a clause of BCC T&C;
  6. a reference to a document includes all amendments or supplements to that document, or replacements or notations of it; and
  7. whenever the words “include”, “includes” or “including” (or similar terms) are used in BCC T&C, they are deemed to be followed by the words “without limitation”.

5. General Conditions

  1. BCC T&C is available from www.bakucitycircuit.com, at Authorised Retail Outlets or by calling the Booking Hotline.
    It is the Entrant's responsibility to read, understand and comply with BCC T&C.
    The Entrant acknowledges that motor racing, the Event and certain activities associated with the Event (including without limitation support events) are dangerous and the Entrant agrees to attend at his/her own risk. Each Entrant is reminded, agrees, accepts and acknowledges that the Circuit is a dangerous place and that certain Events and activities associated therewith are dangerous and accidents can happen. By attending any Event, entering into and/or remaining at the Circuit each Entrant is deemed to have accepted BCC T&C and any accompanying risks, obligations and responsibilities. Each Entrant is warned that there is a possibility of an accident causing injury, death or property damage or loss and attending any Event, entering into and/or remaining at the Circuit is solely at the Entrant’s own risk and that Entrant assumes such risk. Each Entrant acknowledges that the risks associated with attending or participating in any Event, entering into and/or remaining at the Circuit includes the risk of suffering harm as a result of motor vehicles (or parts of them) colliding with other motor vehicles, persons or property. At certain times, including in relation to certain Events, and for safety and operational reasons, BCC may advise that children (aged under eighteen) do not attend the Circuit. BCC prohibits persons under the eighteen (18) years of age from attending an Event, entering into and/or remaining at the Circuit, unless accompanied by a parent or guardian who is over eighteen (18) years of age. The protection of any person who is under the care of another, (including any person under eighteen (18) years of age) is the sole responsibility of the accompanying parent or guardian. Each Entrant is strongly advised to exercise diligent supervision and extreme caution when attending an Event, entering into and/or remaining at the Circuit with a person under eighteen (18) years of age.
    BCC and Associated Entities are not responsible for any loss or damage howsoever caused to the Entrant or his/her property including as part of the Recreational Services to the maximum extent permitted by the laws of the Republic of Azerbaijan (save that nothing in these conditions limits or excludes (a) liability for death or personal injury arising out of the negligence of any of the above-mentioned parties, or (b) any damage incurred by way of fraud or fraudulent misrepresentation by any of the above-mentioned parties).
    To the extent permitted by law, each Entrant acknowledges that, to the extent to which such Entrant participates in:
  2. a sporting activity or similar leisure time pursuit; and/or
    an activity that involves a significant degree of physical exertion or physical risk; and/or
    is undertaken for the purposes of recreation, enjoyment or leisure, (“Recreational Services”), including any pre-Event, post-Event and contemporaneous activities, pit walks and participation in various amusements and interactive displays, BCC and the Associated Entities do not make any warranty that the Recreational Services will be provided with due care and skill or that any materials provided in connection with the Recreational Services will be fit for the purposes for which they are supplied. Each Entrant acknowledges that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.
  3. Without limiting any other release or limitation of liability contained in BCC T&C, BCC and the Associated Entities will not be liable for any indirect or consequential loss (including, but not limited to, loss of earnings), suffered by any Entrant(s) or caused by any acts or omissions of BCC and the Associated Entities, their directors, employees, agents and contractors.
    BCC reserves the right, with reasonable cause (which includes failure to comply with BCC T&C) to refuse entry to any Entrant(s) or remove any Entrant(s) from the Circuit.
    Each Entrant is solely responsible for complying with all immigration, customs and legal requirements of any relevant authority for entry into the Republic of Azerbaijan. In relation to an Event, no exchanges, refunds or replacements of Tickets will be made due to an Entrant’s failure to comply with such requirements or his or her inability to obtain (or his or her denial, cancellation, expiration or revocation of) an entry visa or permit, for any reason whatsoever (excluding travel ban or quarantine imposed by the relevant authorities in the country of departure and/or the country of destination due to COVID-19). Each Entrant is advised to review all immigration, customs and legal requirements for entry into the Republic of Azerbaijan prior to purchasing any Ticket(s) for an Event.
    No person may use the name of the Grand Prix or part thereof (nor any abbreviation or foreign language version thereof) nor any logo or graphic device of or relating to the Grand Prix for any commercial purpose whatsoever without the prior written consent of FOWC first being obtained exercisable in FOWC’s discretion and/or any logo or trademark of or relating to BCC for any commercial purpose whatsoever without the prior written consent of BCC.
  4. Restrictions against Ticket re-selling and unauthorised tickets
  5. Tickets to the Event are strictly non-transferable and not for resale.
  6. No ticket for the Event may be on-sold or offered for resale for any form of fee or reward without the prior written consent of the BCC and FOWC first being obtained and without complying with these BCC T&C in all respects.
  7. Each Entrant must not, without the prior written consent of FOWC and BCC first being obtained, resell, transfer (for commercial or personal gain) or distribute any Ticket(s) for an Event, or purchase or obtain Ticket(s) from or through any commercial agent or company other than BCC or an Authorised Agent.
    Ticket(s) may not be used for advertising, promotion, trade incentives or other commercial purposes including, but not limited to, raffles, contests, sweepstakes, prizes, lotteries or draws to enhance the demand for other goods and services or packaged with hospitality or other products without the express written consent of FOWC and BCC first being obtained, which may attach any conditions it sees fit. Such consent may be withheld at BCC and FOWC’s discretion.
    Any Ticket(s) purchased, sold or used in contravention to BCC T&C will be deemed void and may result in the following:
  8. denial of entry to the Circuit;
    eviction from the Circuit;
    cancellation of Ticket with no refund; and/or
    legal action.

7. Seat Allocations and Viewing for Events

  1. BCC reserves the right to determine at any time with or without notice all seating allocations, viewing areas and other conveniences and attractions in relation to any particular Event. Each Entrant must not place any reliance on Circuit maps or other impressions as they are provided only as an approximate guide to indicate the locations of seating, viewing areas and other conveniences and attractions.
    Each Entrant for an Event acknowledges and accepts that some seats may have restricted viewing or leg room and that natural or man-made obstructions in some areas may impede viewing. BCC reserves the right at its sole discretion to issue last minute changes to seating arrangements for Events which may result in Entrant(s) being assigned seats with obstructed views or restricted leg room. Should BCC issue any significant changes to an Entrant’s reserved seating arrangements, BCC will notify the Entrant(s) directly of such changes and endeavour to provide alternative seating arrangements. Should the alternative seating arrangements not be satisfactory, BCC will offer such Entrant(s) the opportunity to exchange their Ticket(s) for a Ticket(s) of the same or lower face value or to another seating area. If this is still not acceptable, BCC will refund the cost of the Ticket(s) (excluding the cost of any delivery or associated expenses).
    Some areas at the Circuit are exposed to direct sunlight and heat. Each Entrant is required to take appropriate care for their wellbeing including appropriate hydration and sun protection.
    Where available, BCC will provide Entrant(s) who are in wheelchairs or whom have limited mobility with appropriate accessible seating for Events. Should an Entrant require this kind of seating contact should be made with the Booking Hotline to discuss requirements.

8. Ticket Sales and Fulfilment for Events

  1. Tickets for Events may only be purchased from the Website, Authorised Web Agents, the Booking Hotline, Authorised Ticket Kiosks or Authorised Retail Agents.
    Tickets will be sold on a first come – first served, best seat basis, subject to availability.
    BCC requires that each Entrant who is under eighteen (18) years of age at the time of purchase may only purchase Ticket(s) under the supervision and with the permission of his or her parent(s) or guardian(s) who will be solely responsible for advising such Entrant on BCC T&C. In addition, Entrant who is under eighteen (18) years of age can only attend an Event, enter into and/or remain at the Circuit when he or she is accompanied by a parent or guardian who is over eighteen (18) years of age. Children under age two (2) do not need a Ticket when accompanied by an adult companion Ticket Holder (over the age of eighteen (18)) in possession of a Ticket and valid ID. Children (under age two (2)) will have to be kept on an adult’s lap without occupying a seat.
    BCC shall sell Junior Tickets for spectators between the ages of 2 to 16 years old. Junior Tickets can only be sold in conjunction with an Adult ticket. Max. 2 Junior Tickets can be purchased along with an Adult ticket. Ticketholder of Junior Ticket must not be older than 16 years at the time of the Event. Valid ID should be presented at the venue entrance to proof the eligibility.
    For all Events, full payment is required at the time of booking. If insufficient funds are available or if payment cannot be completed in full the transaction will be not be completed and will be voided.
    For certain Events, BCC may specify a maximum number of Tickets that can be purchased by any one individual. If the number of Tickets requested by a Purchaser exceeds the permitted limit, BCC reserves the right to nullify such Order.
    Each Entrant who elects to have their Tickets for an Event delivered by courier will bear all courier, delivery and/or postal charges incurred relation or ancillary thereto.
    A physical address must be provided at the time of booking and the Entrant or its duly authorised designee must be available to sign for and receive the Ticket(s) during the hours of courier delivery in their jurisdiction.
    Changes to delivery address details may only be made by calling the Booking Hotline. It is the sole responsibility of an Entrant who has purchased or obtained Ticket(s) for an Event to notify BCC of any change prior to the Ticket(s) being dispatched. Each Entrant who has purchased or obtained Ticket(s) for an Event agrees and acknowledges that after the time of dispatch, no changes can be made to delivery address details.
    BCC accepts no responsibility for Tickets lost or misplaced by the courier company or postal service. If any Entrant has elected to have their Ticket(s) delivered by courier or postal service and has not received their Ticket(s) within seven (7) days before the Event commencement date, it is the Entrant’s responsibility to report this to the Booking Hotline. The original Ticket(s) will be cancelled and replacement Ticket(s) will be either couriered (if sufficient time is available to do so) or made available for collection. Courier charges for the replacement of misplaced Ticket(s) will be at the Entrant’s expense.
    Concession prices (if any) will only be available to those classes of persons whom BCC officially publishes as being eligible for the concession price. Identification and/or evidence of qualification for the concession price must be produced when purchasing Ticket(s) and when entering the Circuit.
    Unless specifically stated, Ticket prices do not include any goods or any services other than entry to the Circuit and/or attendance at the particular Event.
    Tickets purchased by local spectators through the BCC Website and Authorised Ticket Kiosks can be collected from the Ticket collection points on such dates and times all as detailed on the BCC web page.
    Only the Purchaser can collect the tickets by providing valid ID, a medical certificate (where relevant), and a copy of the Ticket Purchase Confirmation.
    Following collection of Tickets, the Purchaser is solely responsible for safeguarding all Tickets. Removing any part of, altering or defacing a Ticket may result in entry to a Venue being refused.

9. Ticket refunds, exchanges and replacements

  1. Except as provided in Clause ‎9.2 below, a Ticket cannot be refunded or exchanged after purchase (except for a Ticket of greater value, subject to availability) under any circumstances including:
  2. the appearance or non-appearance of any particular person, group, car, event, race, activity or team expected by the Entrant(s), whether or not such appearance or non-appearance was advertised or made known prior to the Event;
    variations in the Event programme, attractions or conveniences;
    any circumstances beyond the reasonable control of BCC and/or the Associated Entities, including but not limited to adverse weather conditions, act of God, act of government or state (including any period of declared national mourning or holiday for the Republic of Azerbaijan), act of any third party that is out of the control of BCC, war, terrorism, civil commotion or insurrection, or labour disputes of whatever nature;
    a change in an Entrant's personal circumstances; or
    the inability or failure of an Entrant to enter the Republic of Azerbaijan due to his or her inability to obtain (or his or her denial, cancellation, expiration or revocation of) an entry visa or permit, for any reason whatsoever;
  3. BCC will refund the face value of the Ticket to the original purchaser if:
  4. the Event is cancelled in its entirety and cannot be re-scheduled; or
    the dates of the Event are changed after they have been confirmed and the relevant Entrant has confirmed in writing to BCC that they do not wish to attend the Event on the re-scheduled dates; or
    there is a significant change in the Entrant’s reserved seating arrangements (other than as described in Clause ‎7.2 and at BCC’s sole and absolute discretion); or
    the Entrant is entitled to a refund by virtue of the operation of the laws of the Republic of Azerbaijan;
    the Event takes place without the spectators or is cancelled both as a result of the administrative actions made by the relevant authorities as a measure against the COVID-19 disease and/or the Entrants are unable to visit the Event as part of travel ban or quarantine imposed by the relevant authorities in the country of departure and/or the country of destination for the same reason. The original Ticket must be produced by the Entrant to obtain the refund. Neither BCC nor the Associated Entities are liable for any loss or damage that is incurred by an Entrant as a result of an Event (or any part of an Event) being cancelled, postponed or changed.
  5. BCC is not obliged to replace Tickets under any circumstances. However, BCC may, in its sole discretion and subject to the payment of a fee to cover administrative costs, agree to replace a Ticket that has been lost or stolen.
    For the avoidance of doubt, in respect of a Ticket for which monetary consideration has not been paid, no refund or other costs will be paid or payable to the holder of such Ticket pursuant to this Clause ‎9. Furthermore, neither BCC nor the Associated Entities will be liable to the holder of such Ticket for any loss or damage suffered as a result of the Event (or any part thereof) being cancelled, postponed or changed.
    BCC accepts no responsibility for stolen or counterfeit Tickets purchased or obtained through unauthorised sources. Entrants who are found to be in possession of Ticket(s) that are counterfeit or have been reported as lost or stolen will be denied entry or expelled from the Circuit and may be liable to legal action.
    Any Entrant with a valid enquiry in relation to a request for a refund pursuant to this Clause ‎9 should contact the Booking Hotline.

10. Security, Conduct and Attendance

  1. Each Entrant agrees to comply with:
  2. the conditions displayed at the entrance to the Circuit;
    BCC T&C;
    the security arrangements, notices or announcements displayed or given by the Police or agents representing any of the Associated Entities, including, without limitation, all directions or notices relating to access and security at the Event;
    all laws and regulations of the Republic of Azerbaijan;
    requests of the Police;
    requests of BCC or agents of BCC or any of the Associated Entities with regards to the activities of BCC, the Events and/or the use or occupancy of the Circuit and its facilities.
  3. For reasons of security and safety, BCC reserves the right to inspect any possessions or persons entering the Circuit. BCC also reserves the right to refuse bags and/or other items being brought into the Circuit, and with reasonable cause, to refuse entry to any Entrant or remove any Entrant from the Circuit. Any consent given by BCC or anyone duly authorized on its behalf (each an “Authorized Representative”) may be revoked by BCC at any time. If such consent is withdrawn, the Entrant must immediately remove or hand to BCC or the Authorized Representative, the offending article or immediately leave the Circuit through the nearest exit, as directed by BCC or its Authorized Representative.
    Due to health and safety issues, BCC may require that Entrants below the six (6) years of age do not attend the Circuit at particular times, including certain Events. BCC may recommend that Entrants wear appropriate ear protection and/or other protective clothing or equipment during certain Events. If BCC does issue such a recommendation, each Entrant must also ensure that any Entrant below the eighteen (18) years of age or any other person within in their care wears appropriate ear protection and/or other protective clothing or equipment as directed by BCC. Their protection is the sole responsibility of the accompanying parent or guardian.
    Each Entrant must not, without the prior consent of BCC, have in their possession, or bring into the Circuit, any of the following items and BCC reserves the right to amend this list at any time:
  4. Explosive or other substances/objects having inside explosive ingredients:
  5. Gun-powder in all packages/bundles;
    Shell casings (also small caliber);
    Casings for gas guns;
    Capsules used for hunting;
    Pyrotechnical resources (flares, smoke emitting devices);
    Sparklers, fireworks, detonators;
    TNT, dynamite, ammonia and plastic explosives;
    Detonator capsules, electrical detonators, electrical flammables, detonating cord.
  6. Guns and ammunition:
  7. Firearms/fire-guns;
    Signal guns;
    Pneumatic guns;
    All types of ammunition;
    Electroshock equipment;
    All main parts of fire guns;
    All objects, which can be used as guns.
  8. Gases - compressed and non-compressed.
    Flammable liquids and solids.
    Oxidizing substances and organic peroxide substances.
    Toxic substances radioactive substances other corrosion substances.
    Poisonous and toxic substances.
    Also other dangerous substances and packages, which can be used for attack or could cause problems during the event.
    Medicines/Drugs and other medical substances in excess of the permitted quality and volume (all guests/visitors can take one package of up to three types of medicines in all forms inclusive aerosols, capsules, injections and etc. in fabric manufactures package/bundle). Volume of all medicines should not exceed 100 ml.
    Drugs and Psychotropic drugs.
    Knifes, cutting tools and other objects or edged weapons.
    Liquids in volumes in excess of 100 ml.
    Glass containers and bottles.
    drones
    All other objects, which could be interpreted as prohibited and dangerous items.
  9. List of other items prohibited by BCC:
  10. Bicycles, skateboards, scooters.
    Large photographic and/or broadcast equipment over 30cm in length including Tripod or monopods for
    Any device with a laser beam / laser pointers.
    Unlicensed Wireless Devices such as transmitters and radios.
    Large bags or bags that have a rigid frame and will not fit under the seat on the viewing platform.
    Animals (except service animals).
    Large umbrellas.
    Devices producing excessive noise and capable of interfering with viewing and competition (vuvuzela, drum, whistle, horn/ whistle, horns).
    Rigid poles, (including fishing poles) used to hold flags.
    Large food containers, ice buckets.
    Signage, clothing and banners containing religious, political, provocative or obscene content.
    Food products not for personal consumption.
    Alcohol and non-alcoholic drinks.
    Articles which Entrants intend to, or BCC considers an Entrant to distribute, sell, offer expose for sale or display for marketing, promotional or commercial purposes or for gain.
    Any flags or banners larger than 1 metre x 2 metres, or flags associated with (i) countries not participating in the event or (ii) causes, affiliations or organisations.
  11. BCC reserves the right to amend this list of prohibited items at any time and will be as set out on the BCC Official Website.
    No objects that may cause damage to spectators (and/ or other persons) and/or property, or cause disturbance to the regular and orderly execution of the Event (as determined by BCC in its sole discretion), may be brought.
    Entrant acknowledges that if it arrives to Circuit with a prohibited item it will not be entitled to enter with that item.
    Any Entrant found to be in possession of a prohibited item(s) shall have the item(s) seized and removed from the Circuit. Ticket Holders in possession of prohibited item(s) by the legislation of the Republic of Azerbaijan (weapons, drugs or explosives, etc.) are subject to arrest and/or prosecution by the relevant authorities
    BCC and the Associated Entities, and each of them, shall not be liable for lost or damaged property brought by Entrant(s) into the Circuit. Cloaking facilities are not available at the Circuit.
    Each Entrant agrees to compensate BCC and/or the Associated Entities for any and all damage, loss, liability or injury that they suffer or may suffer as a result of the Entrant(s)’ failure to comply with the BCC T&C or the wilful, reckless or negligent acts or omissions of the Entrant, or any person with the Entrant’s care, guidance or supervision, within the Circuit or in relation to an Event, to the maximum extent permitted by the laws of Azerbaijan.
    Each Entrant must not without the prior written consent of BCC:
  12. be on the Circuit;
    remain at the Circuit outside the published closing times;
    leave the Circuit and/or an Event other than through a designated exit;
    remove any glass object from a reserved area;
    enter any fence or cordoned off area, or interfere with any activity undertaken by BCC in any fenced or cordoned off area;
    erect any structure, or erect or display any sign or banner;
    pick, damage or uproot any tree or shrub, disturb or interfere with any fauna;
    climb or remain on any tree or structure;
    post, stick or place any poster, placard, bill, banner print, paper or any advertising material on any building, structure, fence, tree or cordon;
    distribute any printed or visual matter or distribute, display or promote any advertising or promotional material, samples of goods or services or any other matter or thing;
    distribute, hawk, sell, offer or expose for sale any goods or services or collect money or orders for goods and services;
    sell, offer or make available for sale, or give away any Ticket;
    misuse, deface, damage, or tamper with any building, seat, chair, table, structure, vehicle, vessel, truck, pipe, tap, tap-fitting, conduit, electrical equipment, wiring, or sign;
    block any thoroughfare including, without limitation, any stairs, steps, aisle, gangway, overpass, underpass, pontoon, bridge, passage, entry or exit;
    deposit litter, except in a receptacle provided for that purpose;
    throw or kick any stone, bottle or other projectile;
    disrupt, interrupt or behave in any manner that may disrupt or interrupt any race, event or activity;
    act or conduct oneself in such a way as to hinder, obstruct or interfere with a driver of any vehicle taking part in a race or to adversely affect the safety of the public;
    deliberately obstruct the view of any Entrant seated in a seat in the immediate vicinity, or cause unreasonable annoyance to any other Entrant(s), official or employee or contractor of BCC, or interfere with the comfort of any Entrant(s) or their enjoyment of an Event;
    use indecent or obscene language or threatening or insulting words or otherwise behave in a threatening, abusive, riotous, indecent or insulting manner;
    interfere with, obstruct or hinder an Authorized Person in the exercise of his or her powers, functions or duties;
    operate or use a loud hailer, public address system, broadcast device or other device which may interfere with electronic or radio communications being used by BCC or other persons authorized by BCC;
    conduct public surveys or opinion polls, solicit money, donations or subscriptions from members of the public;
    busk or conduct entertainment;
    smoke in a designated no smoking area; or
    make, create, store, record or transmit any kind of sound recording, visual footage or audio-visual footage (Recording), including photographic images and any still pictures derived or capable of being derived from a Recording (Image) or store, record or transmit any information or other data, including official timing, results, performance, telemetry, weather or race control data (Data) of, at, or in relation to the Event other than for personal, private and non-commercial purposes, unless expressly permitted by BCC and/or FOWC or its agents.
    Failure to comply with the access control system for the event, including:
  13. Improperly crossing the security perimeter;
    Attempts to access restricted areas without relevant permission.
  14. Breach of public order, including:
  15. Any action (including with banners, chants, shouts, gestures) aimed at inciting social, racial, sexual, religious, national and interstate hatred or supremacy;
    Smoking outside of designated and marked areas;
    Failure to comply with traffic rules and requirements of the traffic controllers;
    Attempting to scale fences, railings, lighting devices, masts, supporting structures;
    Misusing, tempering with, removing, damaging or defacing any property in the Circuit;
    Organizing and / or participating in unauthorized demonstrations and promotions;
    Unauthorized distribution of leaflets, booklets and publications, promotional materials and clothing;
    Being in the Circuit with animals (other than service animals for Entrants with a disability) is not allowed under these BCC T&C;
    Cycling;
    Any criminal activity, including fraud or theft; and
    Being in the Circuit in stained clothes, carrying dirty and foul-smelling objects.
  16. Obstructing the viewing and / or the disrupting the normal course of the Event, including:
  17. Unauthorized removal, relocation and/or vandalism of the signage at the Circuit;
    Demonstration:
    any signs and/or banners without BCC’s written consent (except banners, not larger than 1 metre x 2 meters, whose content should be aimed at supporting the competing athletes and should not contain offensive, obscene, provocative texts, words, symbols and images);
    any flags except country specific flags that are participating in the event;
    Banners and posters, if they contain trademarks or other type of advertising signs, information, or promotion without prior written approval of the BCC;
    any flags or banners larger than1 metre x 2 metres;
    Unauthorized attachment of permitted flags and banners onto the surfaces of buildings and/or structures in the Circuit;
    Public nuisance by nudity while in the Circuit;
    Throwing objects in the Circuit, in particular into the stands, the field of play and the space around it or at the spectators, athletes, coaches, referees, sports facilities, law enforcement officers and other officials;
    The use of devices or instruments that produce noise that can interfere with viewing and competition (vuvuzela, drum, whistle, horn / whistle, horn);
    Starting or attempting to start a fire;
    Conducting entertainment without a licence and authorization from BCC;
    Unauthorized presence in the aisles and on the stairs of sports facilities, as well as, obstructing the movement of participants and spectators.
  18. Unauthorized use of objects and devices, including:
  19. Broadcasting and recording by transmitting devices (including mobile phones or such) using illuminating equipment;
    Inside the indoor parts of the Circuit - flash photography and the use of other lighting devices;
    Use of laser devices;
    Use of sports equipment;
    Use of unauthorized or unmarked electronic and high-frequency devices.
  20. Unauthorized commercial activity including
  21. Posting, sticking, or placing or attempting to post, stick or place, any poster, placard, bill. Banner, print, paper or any advertising material on any building, seat structure, fence, tree or cordon within an event;
    Distribution, display or other use of any advertising or promotion material, matter or thing (including printed or electronic matter or samples);
    Sale of goods by unauthorised persons;
    Sale of counterfeit goods;
  22. Requests for donations in cash or in-kind not authorized by BCC (e.g., musicians or singers at the entrance, charity collections).
  23. Entrants who do not comply with these BCC T&C may be removed from the Circuit, or not admitted into the Circuit/Event, without refund. Entrants’ illegal actions may be prosecuted in accordance with the legislation of the Republic of Azerbaijan.
    In relation to certain events and as a condition of use of the Circuit Entrants , and such other persons as BCC may designate from time to time, may be required to enter into, and at all times comply with, a waiver and indemnity in such form as BCC may, in its absolute and sole discretion decide. For those events, you will be required to ensure that all signed waiver and indemnity form(s) are duly completed (accurately and legibly) and delivered to BCC prior to use of the circuit.
    Whilst at an Event and at the Circuit, Entrants must take care to protect your safety and the safety of others. Entrants are required to take appropriate care for your sun protection and hydration, and must wear appropriate footwear and clothing at all times. Volume levels at any Event may vary, and it is recommended that you take appropriate care for your hearing protection, including using earplugs.

11. Circuit Access and Entry

  1. Each Entrant is only permitted to access the open areas of the Circuit and must not enter any of the restricted areas designated by BCC or any of the Associated Entities.
    Entrants under eighteen (18) years of age must be accompanied and supervised by his or her parent or guardian. At such times, each parent or guardian must also:
  2. be in possession of a valid Ticket if attending an Event;
    be responsible for the care, conduct and supervision of such persons at all times; and
    must keep them within sight at all times, particularly within the vicinity of the Circuit. Entrant(s) under eighteen (18) years of age may not be permitted to enter certain areas of the Circuit for safety reasons as determined or advised by BCC in its absolute discretion.
  3. After entry to the Circuit has been granted to an Entrant on a particular Event day, Tickets are non-transferable for that Event day. Each Entrant must be in possession of a valid Ticket at all times. No person will be admitted to the Circuit for an Event without a Ticket. BCC reserves the right to refuse entry to a person for an Event who is not in possession of a valid Ticket and may ask that person to leave the Circuit. BCC reserves the right to charge a fee for the replacement of Tickets. BCC reserves the right not to replace Tickets that are lost, stolen, counterfeit, damaged or unreadable.
    As a condition of entry into and remaining at the Circuit, each Entrant acknowledges and accepts that certain activities at the Circuit, including motor racing and other activities associated therewith are dangerous and attending the Circuit may involve personal risk to Entrant(s). Attendance at the Circuit is entirely at the Entrant’s own risk. Each Entrant is reminded of, agrees, accepts and acknowledges the warnings, indemnities and limitation of liabilities in BCC T&C.
    BCC reserves the right to refuse admission to (or eject from) the Venue any person (a) not complying with these BCC T&C; (b) not in possession of a valid ticket; (c) who is in possession of a ticket which has been sold or used other than in compliance with these BCC T&C; or (d) on grounds of health, safety, security or maintaining good public order.

12. Alterations to Events

  1. BCC reserves the right, without notice, to add, withdraw, reschedule or substitute any particular person, group, car, race, team or personality from an Event, to amend Ticket prices, seating arrangements and audience capacity whether advertised or not and whether expected to be in the Event or not. BCC or the Associated Entities are not liable to Entrants for any changes in the participants or format of, or any other element of an Event arising from the arrangement of a substitute event. BCC is the appointed event delivery company and exclusive distributor of Tickets for Events to be held at the Circuit and other entities (the actions of whom are not controlled by BCC) may elect to cancel, postpone or change the date and time of an Event and BCC or the Associated Entities are not responsible or liable to Entrants for any loss or damage, whether direct or indirect, that is incurred as a result of an Event (or any part of an Event) being cancelled, postponed or changed. BCC and the Associated Entities provide no warranty, guarantee, promise of any nature regarding the date and time of a particular Event and cannot warrant, guarantee or promise that an Event will not be cancelled, postponed or changed.
    BCC, FOWC and the FIA reserve the right to delay or postpone an Event, and if necessary to cancel or abandon an Event entirely due to adverse weather conditions. (The Event may resume on the same or next day after such delay or postponement).
    BCC shall reimburse the Entrants, in case the Event takes place without the spectators or is cancelled both as a result of the administrative actions made by the relevant authorities as a measure against the COVID-19 disease. In addition, BCC shall reimburse Entrants in case they are unable to visit the Event as part of travel ban or quarantine imposed by the relevant authorities in the country of departure and/or the country of destination for the same reason.
  2. Photographs, Images & Recording and the Collection of Information
  3. Entrant must not make, create, store, record or transmit any kind of sound recording, visual footage or audio-visual footage (“Recording”), or store, record or transmit any information or other data, including official timing, results, performance, telemetry, weather or race control data (“Data”) of, at, or in relation to the Event. It is forbidden to take into the Venue any equipment that may enable you to do the aforementioned acts. Personal electronic devices (including still image cameras, mobile telephones and other handheld personal communications devices) are permitted within the Venue unless otherwise advised, provided that any Recording, Data and any image, including photographic images and any still pictures derived or capable of being derived from a Recording (Image) of the Event that is recorded, stored and/or created thereon is used for personal, private and non-commercial purposes only.
    For the purposes of this Clause ‎13, “Recording Equipment” means any equipment that may enable an Entrant to make, create, store, record, reproduce or transmit any kind of Recording, Image or Data.
    Unless authorised by BCC and FOWC in writing, each Entrant must not bring into or use within the Circuit any professional Recording Equipment or any Recording Equipment deemed unacceptable by BCC and FOWC in its absolute discretion having regard to the purposes of this Clause ‎13. Subject to Clause ‎13.3, personal electronic devices (including still image cameras, mobile telephones and other personal communications and handheld devices) are permitted within the Circuit unless otherwise advised.
    Entrants must not make, create, store, record, transmit, reproduce, broadcast, stream, use, sell, licence or otherwise deal in any Recordings and/or Images or store, record or transmit any Data made within the Circuit of, at or in relation to Event except:
  4. where such is for the private enjoyment of the Entrant; or
    where the Entrant has obtained the prior written consent of the relevant Associated Entity, which, for the purposes of the Grand Prix, shall be FOWC.
  5. As a condition of entry to the Venue, the Entrant agrees that (a) the use of any such Recording, Data or Image for any form of public advertisement, display, commercial gain or for any other purpose (except for your private enjoyment) without the prior written consent of FOWC is strictly forbidden and will constitute a breach of these BCC T&C for which Entrant may be liable; and (b) on request by BCC or FOWC, the Entrant shall assign to FOWC in writing the copyright and all other intellectual property in any Image or Recording that Entrant create, make, store or record of, at or in relation to the Event; and (c) the Entrant consents to the use by FOWC (and by any third party authorized by FOWC from time to time) for the purposes of or in connection with any publication, exhibition or broadcast (including any advertising or promotional literature, campaign or material) in any media worldwide, in perpetuity and on a royalty-free basis, and approved by FOWC of any still or moving picture images taken at the Event where such image includes any image of the Entrant, his/her voice or his/her likeness and the Entrant waive any and all of his/her personality and privacy rights to the extent necessary to permit such use.
    FOWC has the right to admit any authorised photographers into the Circuit for photography and/or video recordings for future advertising and promotional purposes without any requirement for permission from any Entrant whatsoever.
    Each Entrant agrees that BCC may collect, operate and transfer personal information about him or her for operational, research, marketing and promotional activities in relation to Events to the extent and for a period allowed under the Laws of the Republic of Azerbaijan until being archived or destroyed in accordance with those Laws. In particular, BCC may collect the name, address and phone number of Entrants for the purposes of coordinating the seating and/or viewing arrangements for Events. Unless the Entrant advises BCC otherwise, each Entrant irrevocably consents to receiving future promotions and marketing communications from BCC, including via electronic messaging such as email and SMS.

14. Miscellaneous

  1. Amendments or variations of BCC T&C are only valid and binding if made or confirmed by BCC in writing which includes the publication of a notice on the Website.
    Each of the provisions of BCC T&C is severable from the other(s). If any provision or part of a provision is or becomes invalid, unenforceable or illegal in any respect, such provision or part of such provision will, to the extent that the term is invalid, be deemed not to form part of BCC T&C. The remaining provisions or parts of such provisions will not be invalidated in any way.
    BCC T&C are available in both Azerbaijani and English. In the event of any inconsistency between the Azerbaijani and English versions of BCC T&C, the English shall prevail.
    BCC T&C are governed by and construed, performed and enforced in all respects in accordance with the laws of the Republic of Azerbaijan, without giving effect to the principals of conflicts of laws or choice of law provisions therein. Each Entrant hereby submits to the exclusive jurisdiction of the courts in the Republic of Azerbaijan.
